The widow of a highly-regarded documentary film maker has won a High Court battle against three doctors who failed to diagnose and treat her husband's hypertension.
Nick Rossiter, who was 43 when he died, had been a patient at the doctors’ surgery since late 2001. The doctors admitted failing to identify his worsening hypertensive condition and to prescribe the appropriate medication from April 2002 onwards. On his final visit to the surgery, in May 2004, Mr Rossiter left without having been given a vital blood pressure test. He died of a heart attack two months later.
The three doctors argued that even if Mr Rossiter had been prescribed the appropriate medication for his condition, he might not have completed the course of treatment. However, lawyers for Mr Rossiter’s wife, Bea Ballard, argued that her husband was an intelligent man who had given up smoking and was devoted to his family. His death could have been avoided if a proper system had been put in place to control his blood pressure.
The judge approved a payout to Mr Rossiter’s widow and children. Although the amount of the compensation award was undisclosed, it was estimated to be in the region of £2 million.
