Personal Injury Claims - How they work.

If we think you would be entitled to personal injury compensation, we then set up an initial meeting, which can be at your home or in hospital, or at our offices. This meeting is free and there is no obligation on your part to proceed if you are not satisfied with anything at the end of the meeting. During this meeting we will explain in detail how the personal injury claim works and go through the circumstances of the accident and what has happened to you since you suffered your injuries.

If we think you would be entitled to personal injury compensation, we then proceed with the claim against the party who caused your accident. They can be an individual, organisation, company, authority or another kind of group. The vast majority of personal injury claims are handled by the insurers of the party that caused your accident. If your personal injury claim is successful, you would be entitled to compensation for the injuries you have suffered, and the expenses you have incurred as a result of your accident, such as lost earnings, medical expenses, travel costs etc.

Your accident must have happened within the last three years, unless you are under 18, in which case you have 3 years from your 18th birthday to issue a personal injury claim in court.

Why No Fee - Win or Lose?

The essence of Personal Injury claims is that you are claiming compensation from another party that caused your accident, normally through their own negligence or failing to take reasonable care for your safety. Therefore the system in English law allows you to claim compensation for your injuries from the party that caused your accident, but also for your solicitor to claim their legal costs from that party as well.

What if I lose?

If you lose, you do not have to pay a penny. We will cover our own legal costs, and our high level of expertise ensures we have a very large success rate in making personal injury claims.

How much compensation do I keep?

You keep 100%. The system outlined above means that we get our legal costs from the same people that caused your accident.

Do I have to fund the experts and barristers fees?

No. You will not have to fund any of the expenses (called disbursements) in running the claim. The disbursements include medical report fees, medical record fees, experts fees and barristers fees.

Am I protected from all costs if I lose?

If we agree to take your claim on, we can set up what is called "conditional fee insurance," which will cover you in the event that your claim goes all the way to court and loses, so that you would not have to pay your opponent's legal costs.
